Welcome to SST.NYC. These Terms of Service (“Terms”) govern your use of our website, services, and online training courses. By accessing or using SST.NYC, you agree to be bound by these Terms. If you don’t agree, please don’t use our services.

We provide online Site Safety Training (SST) courses approved by the New York City Department of Buildings (NYC DOB) under Local Law 196 of 2017.

2. Acceptance of Terms

By creating an account, enrolling in a course, or using any part of our website, you confirm that:

  • You are at least 18 years old (or have parental/guardian consent)
  • You have read, understood, and agree to these Terms
  • You agree to comply with all applicable laws and regulations
  • All information you provide to us is accurate and current

If you’re enrolling on behalf of an employer or organization, you represent that you have authority to bind that entity to these Terms.

3. Description of Services

SST.NYC provides:

  • Online training courses for NYC DOB Site Safety Training requirements
  • Digital course materials including videos, readings, and assessments
  • Progress tracking through our learning management system
  • NYC DOB SST card processing upon successful course completion
  • Customer support via email and SMS

Our courses are designed to meet NYC DOB requirements under Local Law 196. However, it is your responsibility to ensure you’re enrolling in the correct course for your job role and compliance needs.

What We Don’t Provide

  • We are not a job placement service
  • We do not guarantee employment or specific outcomes from completing our courses
  • We are not responsible for NYC DOB policy changes that may affect your SST card validity

4. Account Registration & User Responsibilities

Creating an Account

To enroll in courses, you must create an account with accurate information:

  • Full legal name (as it should appear on your SST card)
  • Valid email address
  • Phone number
  • Mailing address for SST card delivery

Account Security

You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

Account sharing is prohibited. Each student must have their own individual account. Accounts found to be shared may be suspended or terminated without refund.

Prohibited Conduct

You may not:

  • Share course materials, videos, or content outside of the platform
  • Use automated tools (bots, scripts) to access or complete courses
  • Attempt to circumvent quiz requirements or cheat on assessments
  • Upload malicious code or attempt to hack or disrupt our services
  • Create multiple accounts to abuse promotions or discounts
  • Use our services for any illegal purpose

Violations may result in account termination, forfeiture of course access, and denial of SST card processing — all without refund.

5. Course Access & Completion

Course Enrollment

When you purchase a course:

  • You receive immediate access to course materials upon payment confirmation
  • Access remains active until you complete the course (no time limits unless otherwise stated)
  • You must complete all lessons, quizzes, and assessments to receive your SST card

Technical Requirements

You are responsible for having:

  • A reliable internet connection
  • A modern web browser (Chrome, Firefox, Safari, Edge)
  • An email address you check regularly

We are not responsible for technical issues on your end (slow internet, outdated browsers, device malfunctions).

Course Completion Requirements

To receive your NYC DOB SST card, you must:

  • Complete all required lessons and topics
  • Pass all quizzes with the minimum required score (usually 70%)
  • Complete the final exam with the minimum passing score
  • Spend the minimum required time on video lessons (where applicable)

Failing to meet these requirements means you will not receive your SST card. You may retake quizzes and exams according to the course’s retry policy.

6. Payments, Refunds & Pricing

Payment Processing

All payments are processed securely via Stripe through WooCommerce. We do not store your full credit card information on our servers.

Pricing

Course prices are listed in U.S. Dollars (USD) and are subject to change. The price you pay is the price displayed at the time of purchase.

Refund Policy

Digital course sales are generally final. However, we may issue refunds at our discretion in the following cases:

  • Technical issues: If our platform prevents you from accessing your course, and we cannot resolve the issue within a reasonable time
  • Duplicate purchases: If you accidentally purchase the same course twice
  • Wrong course: If you enroll in the wrong course and notify us within 48 hours before starting the course

Refunds will NOT be issued if:

  • You change your mind after starting the course
  • You fail quizzes or exams due to not studying
  • You are unable to complete the course due to time constraints
  • Your employer no longer requires the training
  • You violate these Terms and your account is terminated

To request a refund, email support@sst.nyc with your order number and reason.

7. SST Card Processing

How It Works

Upon successful course completion:

  1. We verify that you’ve met all NYC DOB requirements
  2. We process your SST card application with the NYC DOB
  3. We mail your physical SST card to the address on file

Processing Times

  • SST card processing typically takes 7-14 business days after course completion
  • Delays may occur due to NYC DOB processing times, holidays, or mailing issues

Lost or Undelivered Cards

If your SST card does not arrive within the expected timeframe, contact us at support@sst.nyc to verify your mailing address. Replacement cards may be subject to additional fees.

8. Intellectual Property

All content on SST.NYC is proprietary and protected by copyright, trademark, and other intellectual property laws. This includes course videos, slides, instructional materials, text, graphics, logos, and images.

When you enroll in a course, we grant you a limited, non-exclusive, non-transferable license to access and view course materials solely for your personal educational use.

You may NOT download, copy, reproduce, distribute, sell, or sublicense course content. Violations will result in immediate account termination and may result in legal action.

9. SMS/Text Message Communications

Consent to Receive SMS

By providing your mobile phone number and texting our business number, you consent to receive SMS text messages from SST.NYC for:

  • Customer support updates and responses
  • Course enrollment confirmations
  • SST card processing notifications
  • Account security alerts

Opt-Out Instructions

You can opt out of SMS messages at any time by replying STOP to any message from us. You may also contact us at support@sst.nyc to opt out. Reply HELP for help.

Privacy & Data Sharing

We do not share your mobile phone number or any mobile information with third parties or affiliates for marketing or promotional purposes. Your information is used solely for the purposes described in our Privacy Policy.

Message Frequency & Charges

  • Message frequency varies based on your interactions with us
  • Standard message and data rates may apply (check with your carrier)
  • We are not responsible for carrier-related issues or charges

10. Disclaimer of Warranties

SST.NYC services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.

While our courses are designed to meet NYC DOB requirements, we do not guarantee that the NYC DOB will accept your SST card, that your SST card will remain valid indefinitely, or that completion of our course guarantees compliance with all NYC construction site requirements.

You are responsible for verifying that you’re taking the correct course for your needs and staying current with NYC DOB regulations.

11. Limitation of Liability

To the maximum extent permitted by law, Predictive Safety LLC (SST.NYC) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, job loss, failure to meet NYC DOB requirements, or fines and penalties resulting from non-compliance.

Our total liability to you for any claim arising from your use of SST.NYC shall not exceed the amount you paid us for the specific course in question.

You agree to indemnify, defend, and hold harmless Predictive Safety LLC from any claims, damages, losses, or expenses arising from your violation of these Terms, misuse of our services, or failure to comply with NYC DOB regulations.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or your use of SST.NYC shall be resolved in the state or federal courts located in New York County, New York.

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at support@sst.nyc.

You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class-action lawsuits or class-wide arbitration against SST.NYC.

13. Changes to These Terms

We may update these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Continued use of our services after changes constitutes acceptance of the new Terms.

If you do not agree to updated Terms, you must stop using our services. If you’ve already purchased a course, the Terms in effect at the time of purchase will continue to apply to that course.

14. Termination

We may terminate or suspend your account if you violate these Terms, engage in fraudulent activity, abuse our staff, or if required by law. Upon termination, your access to courses and materials will be revoked and you forfeit any right to refunds or SST card processing.

You may request account deletion by emailing support@sst.nyc. Account deletion does not entitle you to a refund.

15. Miscellaneous

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SST.NYC. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision does not constitute a waiver.

We are not liable for delays or failures due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, or internet outages.
